Income Tax Notice
An income tax notice can be alarming — but with the right guidance, most notices can be resolved without significant financial impact. Income tax notices range from simple intimations (Section 143(1)) to scrutiny assessments and reopening orders. Responding correctly and on time is critical to protect your interests.
Don't Panic — Respond Right
Critical: Every income tax notice has a strict response deadline — typically 15 to 30 days. Ignoring or missing the deadline results in an ex-parte assessment order where the AO adds income and levies maximum penalties without hearing your side. Once an ex-parte order is passed, reversing it requires an appeal — adding months and significant cost.
Section 143(1) Intimation
Most common — CPC processing
143(1) intimations are automated processing results from CPC. They may confirm your return or raise a demand for additional tax. Most are resolved by submitting clarifications or paying the demand.
Section 143(2) Scrutiny Notice
Detailed examination of return
The Assessing Officer selects your return for detailed scrutiny. This requires producing books of accounts, invoices, and evidence for every item in your return. Our CAs represent you through the entire scrutiny process.
Section 148 Reassessment
Reopening of past returns
The AO can reopen a past return if they have reason to believe income has escaped assessment. Time limits apply. We prepare comprehensive responses showing all income was properly disclosed.
Section 156 Demand Notice
Pay or respond within 30 days
A demand notice requires payment of assessed tax within 30 days. We review the demand for errors, file rectification requests where appropriate, or arrange payment while exploring appeal options.
Types of Income Tax Notices
Each notice type has different implications and response requirements.
Intimation under Section 143(1)
Automated intimation after processing your ITR — confirming acceptance, refund amount, or additional tax demand. Must be responded to within 30 days of receipt.
Scrutiny Notice under Section 143(2)
Issued within 3 months of completing the assessment year. Requires detailed documentation and may involve multiple hearings before the AO.
Notice under Section 148/148A
Issued to reopen past assessments where income may have escaped assessment. Requires a preliminary hearing and submission of grounds against reopening before assessment begins.
Show Cause Notice (Section 274)
Issued before levying a penalty — the taxpayer must 'show cause' why a penalty should not be imposed. A well-prepared response can avoid penalties entirely.
Why Professional Notice Response Matters
The way you respond to a tax notice determines whether it becomes a routine closure or an expensive long-term liability.
Timely Response
Every notice has a deadline — typically 15–30 days. Missing the deadline means the AO proceeds ex-parte (without your input), almost always resulting in an unfavourable order.
Complete Documentation
A comprehensive response with all supporting documents — bank statements, invoices, contracts, return copies — prevents follow-up notices and demonstrates total transparency.
Factual & Legal Arguments
Our CAs craft legally sound responses citing applicable sections, circulars, and judicial precedents — protecting your position even if the matter goes to appeal.
Protect Against High Demands
Incorrect responses can result in addition of income and demands that are multiples of the actual issue. Expert handling contains the damage at the first level itself.
Penalty Avoidance
Voluntary disclosure, complete explanation, and good faith cooperation with the department significantly reduces the risk of penalty under Section 270A (misreporting) or 271(1)(c).
Representation in Hearings
Our CAs attend hearings before the Assessing Officer, Commissioner, or tribunal on your behalf — you do not need to personally appear at tax offices.
How We Handle Your Tax Notice
Our structured approach ensures every notice is analyzed, documented, and resolved efficiently.
Scroll through the steps — or skip the queue and let our experts handle every one of them for you.
Get Expert HelpReview the Notice
Carefully review the notice type, section, assessment year, and the specific issues raised. Confirm the deadline for response.
Analyze the Issue
Identify the root cause of the notice — mismatch in AIS/Form 26AS, unreported income, disallowed deductions, or incorrect TDS credit. Compare with the filed ITR.
Gather Supporting Documents
Compile all relevant documents — bank statements, contracts, invoices, investment proofs, prior returns — to substantiate every item challenged in the notice.
Prepare Detailed Response
Draft a comprehensive written response addressing each ground raised in the notice — factually, legally, and with documentary support.
Submit Response Online
File the response on the income tax e-filing portal (Compliance Portal) before the deadline. Retain the acknowledgement as proof of timely submission.
Follow Up & Attend Hearings
If the AO calls for a personal hearing, our CA attends on your behalf with all documents. We follow up until a formal closure order is received.
Documents Needed to Respond to Notices
Documents depend on the notice type, but these are commonly required for most income tax notices.
Return & Financial Records
Filed ITR Copy
Copy of the ITR acknowledgement and computation for the relevant assessment year.
Form 26AS / AIS
Annual Information Statement and Form 26AS for TDS, TCS, and third-party income data.
Bank Statements
All bank account statements for the year in question — for income and transaction verification.
All notices must be responded to through the e-filing portal under the 'e-Proceedings' section. Do not ignore any notice — even a seemingly minor 143(1) intimation — as non-response escalates the matter to demand recovery.
After the Notice Is Resolved
Closure of a notice opens a window for preventive action to avoid future notices.
Obtain Closure Order
Request a written order confirming the assessment is complete and no demand is outstanding. This protects against the same issue being reopened later.
Rectify Root Cause
Identify why the notice was triggered — AIS mismatch, unreported income, or missing documents — and correct the approach in future returns to prevent similar notices.
Appeal if Demand Is Unjust
If the AO's final assessment is incorrect or excessive, file an appeal before the Commissioner of Income Tax (Appeals) within 30 days of receiving the demand order.
