Who Can Register a Trademark?
Any person or entity using (or intending to use) a mark in commerce can apply for registration.
Individuals
Any individual — Indian citizen or foreign national — can apply for trademark registration for personal business or commercial use. Reduced government fees apply for individuals and MSMEs.
Companies & LLPs
Private limited companies, public limited companies, LLPs, and Section 8 companies can register trademarks — with the entity as the trademark owner.
Partnership Firms & Proprietorships
Partnership firms and sole proprietorships can register trademarks in the name of the firm or the proprietor. Ensure the applicant name matches actual business usage.
Foreign Companies
Foreign companies can file trademark applications in India — either directly or through Paris Convention priority (filing in India within 6 months of home country filing). India is a signatory to the Paris Convention.

A registered trademark is the gateway to Amazon Brand Registry, Flipkart Brand Protection, and other e-commerce brand protection programs — preventing hijacking of your product listings.
TM Journal Publication
After passing examination, your mark is published in the Trade Marks Journal. If unopposed for 4 months, registration proceeds — creating a public record of your exclusive rights.

Search the IP India trademark database for identical and similar marks in your class. Also search for phonetically similar marks and check for famous marks that may block registration.
Prepare Application
Prepare Form TM-A with the trademark (word mark or device mark/logo), applicant details, class, and description of goods/services. For logos, upload the device in the required format.
File Application Online
File Form TM-A online on the IP India portal. Pay the government filing fee — ₹4,500 per class for individuals/MSMEs; ₹9,000 per class for companies. Receive application number immediately.
Examination by Registry
The Trademark Registry examines the application for absolute and relative grounds of refusal. If an objection is raised, an examination report is sent within 12–18 months of filing.
Respond to Examination Objection (if any)
Prepare a detailed written reply to examination objections — citing use, distinctiveness, or differences from cited marks. An oral hearing before the Trademark Officer may follow.
Journal Publication & Registration
If accepted, the mark is advertised in the Trade Marks Journal. After 4 months without opposition, the registration certificate is issued — valid for 10 years from the original filing date.
Documents Required for Trademark Application
Documentation is minimal — trademark registration is primarily a legal and strategic process.
Applicant Identity Documents
PAN Card
PAN of the individual, company, or firm applying for the trademark.
Aadhaar / Passport
Identity proof of the applicant — Aadhaar for Indian applicants, passport for foreign nationals.
MSME Registration Certificate
If claiming the concessional ₹4,500 fee as an MSME — Udyam Registration Certificate.
A single trademark application covers one class of goods/services. If your brand spans multiple classes (e.g., a clothing brand also selling footwear and bags), separate applications are required for each class — each with its own filing fee.
After Registration
Registration is not the end — protect and enforce your trademark actively.
Monitor the Trademark Journal
Actively monitor the monthly Trade Marks Journal for similar marks being published. You have 4 months to file an opposition — miss the window and the infringing mark gets registered.
Renew Before Expiry
Trademark registration expires after 10 years. Apply for renewal in Form TM-R within 6 months before expiry. Late renewal is possible with a surcharge — but lapsed marks can be picked up by others.
Enforce Against Infringers
Send cease-and-desist notices to infringers. File a complaint with the police (criminal infringement under Section 103) or approach the district court for civil remedies — injunction, damages, delivery up.
