Governed by the Drugs and Cosmetics Act, 1940, drug licences are issued by the State Drug Controller — ensuring that medicines are sold only by qualified pharmacists and in compliant premises.
The Legal Backbone of Every Pharmaceutical Business
Critical: A drug licence is linked to a specific registered pharmacist. If the pharmacist resigns, retires, or is absent for an extended period, the licence becomes technically inoperable — and selling drugs without a qualified pharmacist on premises is an offence under the Drugs and Cosmetics Act. Replace or update the pharmacist on record with the Drug Control Authority within 30 days of any change.
Retail Drug Licence
For pharmacies and drug stores
Retail Drug Licence (Form 20 and Form 21) is required for every medical shop, pharmacy, or chemist store selling drugs to consumers. A registered pharmacist must be in charge of the premises during business hours.
Wholesale Drug Licence
For distributors and stockists
Wholesale Drug Licence (Form 20B and Form 21B) is for businesses supplying drugs to retailers, hospitals, or institutions — not directly to consumers. Wholesale dealers cannot sell to end consumers without a retail licence.

Schedule H & H1 drugs
Pharmacies dealing in Schedule H and H1 (habit-forming) drugs — like opioids, controlled psychotropic substances — require special endorsements on their drug licence and must maintain separate registers.
Drug Manufacturing Licence
For pharma manufacturers
Pharmaceutical manufacturers require a drug manufacturing licence — issued by CDSCO (Central Drugs Standard Control Organization) for new drugs and by State Drug Controllers for generic formulations.

Every retail pharmacy, chemist shop, or drug store selling prescription or OTC medicines directly to consumers must hold a Retail Drug Licence — and must have a registered pharmacist present during business hours.

Businesses supplying drugs to retailers, hospitals, and clinics need a Wholesale Drug Licence. A person with a B.Pharma/D.Pharma degree or medicine-related graduation must be the approved person.
Hospital Dispensaries
Hospital pharmacies and clinic dispensaries selling medicines to patients must also hold a drug licence — even if medicines are dispensed only to the hospital's own patients.
Online Pharmacy Platforms
E-pharmacies and online drug delivery platforms require drug licences in each state from which medicines are supplied. CDSCO and state drug authorities have specific guidelines for online pharmacy operations.

A registered pharmacist (D.Pharma or B.Pharma holder with state pharmacy council registration) must be the responsible person on the licence. This is a mandatory prerequisite.
Prepare Compliant Premises

A Drug Inspector visits the premises to verify compliance with Drugs and Cosmetics Act requirements — pharmacist availability, storage conditions, premises area, and equipment.
Receive Drug Licence
After satisfactory inspection, the drug licence is issued — specifying the premises address, pharmacist name, drug categories, and licence validity. Display prominently at the pharmacy.

Drug licences are issued for a specific address. If the pharmacy relocates to a new premises, an amended or fresh drug licence application is required for the new address — operating at a different address from the licensed address is illegal.
After Receiving Drug Licence
Compliance is ongoing — drug inspectors can visit at any time.
Maintain Purchase & Sale Registers
Maintain separate registers for purchases and sales — especially for Schedule H, H1, and X (controlled substances) drugs. These registers must be produced on demand by drug inspectors.
Renew Licence Annually
Drug licences must be renewed annually by submitting Form 19A/19C with the state drug authority. Late renewal attracts penalties — operate only with a current, valid licence.
Pharmacist Continuity
The pharmacist named on the licence must be available during business hours. If the pharmacist resigns, immediately apply for a change of pharmacist — operating without the licensed pharmacist is a violation.
