Privacy Policy

This Privacy Policy should be read in consonance with the Terms (available at https://finaceindia.com/term-conditions) and they are incorporated by reference. Capitalised terms not defined herein, shall have the meaning set out in the Terms.

1. INFORMATION WE COLLECT

1.1 When you use our Platform or avail the Services, we seek or collect, amongst others information such as your name, mother's name, father's name, password, date of birth, gender, Permanent Account Number (PAN), signature, marital status, nominee details, cancelled cheque, photograph and video recording, email id, phone number, educational or professional qualification, business name, business address, nature of business, Goods and Services Tax Identification Number ("GSTIN"), Tax Deduction and Collection Account Number (TAN), bank account details, vendor details, United Payments Interface (UPI) ID, and/or other payment and investment information and copies of KYC documents that helps us confirm your identity and facilitate provision of the Services through our Platform. No liability pertaining to the authenticity/genuineness of the information disclosed will lie on the Company. Further, the Company will not be in any way responsible to verify any information obtained from you.

1.2 In case you are required to provide your Aadhaar details to us during account creation, you acknowledge and agree that the act of providing your Aadhaar details to us is voluntary. We require Aadhaar details solely for the purpose of carrying out KYC and for filing of ITRs.

1.3 We collect mobile numbers, e-mail addresses that you provide us on the Platform and use the same for sending various communications to you.

1.4 When you visit our Platform or avail the Services, we collect certain information about your interaction with our Platform including the pages that you view, your internet protocol address, the links you select or actions you take, browser type, the unique identifier of your device and device information such as operating system, operating system version, browser plug-ins, crashes, system activity, hardware settings, location based information, date and time of your request and referral URL, and cookies that may uniquely identify your browser and mobile application and the previously visited webpage.

1.5 We may retrieve your information and records available with third party provider including but not limited to credit score and liabilities information or information from the KYC Registration Agency, Goods and Services Tax Network ("GSTN") and National Informatics Centre such as GST filings, Income Tax returns, ITR filings status, MCA filings status and other government records to facilitate provision of the Services.

1.6 Sensitive Personal Data or Information in relation to your religion, caste, tribe, political belief, health status, family and lifestyle information and payment details will be processed only with your explicit written consent. Such sensitive information will be collected and processed by us in compliance with the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011.

1.7 We collect data through cookies, pixel tags, beacons and similar technologies. You can choose to decline cookies through your browser, however, declining cookies may impair your ability to access or use certain features of the Platform.

2. HOW WE USE YOUR INFORMATION

2.1 We use your information for service delivery, to provide you with the Services you requested and for performing our obligations in relation thereto.

2.2 We use your information to communicate with you regarding updates to the Platform, to provide technical assistance and customer support, to notify you of any changes to your account, to send you service announcements, and to respond to any questions or requests you may have.

2.3 We use your information to track and measure the effectiveness of the Services, to monitor and analyse usage, to personalise your experience and to improve the Platform and the Services.

2.4 We use your information to detect, prevent and address technical and security issues, fraud, and illegal activities, to protect the rights, property and safety of the Company, the Platform, our customers, and the general public.

2.5 We use your information for tax and fiscal purposes, including filing Income Tax Returns, GST Returns, compliance with statutory obligations and for generating reports and documents required by any statutory authority.

2.6 We use your information to send you promotional offers and information about new services and features, if you have opted-in to receive such communications.

2.7 We use your information for conducting surveys, research and analytics to understand your needs, preferences and improve our Services and the Platform.

2.8 We use your information to comply with applicable laws, regulations and to respond to any legal process, including subpoenas and court orders.

3. DISCLOSURE OF INFORMATION

3.1 We may share your information with third parties, including but not limited to government agencies, statutory authorities and regulatory bodies, in compliance with applicable laws and regulations.

3.2 We may share your information with our service providers, business partners and affiliates who assist us in providing the Services or operating the Platform, subject to confidentiality obligations and data protection commitments.

3.3 We may share your information with professional advisors such as accountants, lawyers, auditors and financial advisors to facilitate provision of the Services.

3.4 We may share your information with banks, financial institutions, and other payment service providers for processing payments and managing transactions.

3.5 We may disclose your information in connection with any acquisition, merger, reorganization, bankruptcy or similar event or proceeding, if permitted by law.

3.6 We will not sell, rent or trade your information to third parties for their marketing purposes without your express written consent. However, we may share de-identified or aggregated information with third parties for marketing, advertising, analytics and other purposes.

3.7 We may disclose your information when required by law, court order, or governmental authority, or when we believe in good faith that disclosure is necessary to protect the rights, property, or safety of the Company, the Platform, our customers, or the public.

4. SECURITY OF YOUR INFORMATION

4.1 We implement industry-standard technical, organisational and administrative security measures to protect your information against unauthorised access, alteration, disclosure or destruction.

4.2 Your information is encrypted during transmission using Secure Socket Layer (SSL) technology or other secure protocols. We use firewalls, secure servers and other technologies to protect the confidentiality of your information.

4.3 We implement access controls, authentication mechanisms and role-based access to restrict access to your information to authorised personnel only.

4.4 We conduct regular security assessments, penetration testing and vulnerability scans to identify and address potential security vulnerabilities.

4.5 We maintain incident response and breach notification procedures in accordance with applicable laws and regulations.

4.6 While we take all reasonable measures to protect your information, no method of transmission over the internet or electronic storage is 100% secure. We cannot guarantee absolute security of your information.

5. RETENTION OF YOUR INFORMATION

5.1 We retain your information for as long as necessary to provide the Services, comply with legal and regulatory requirements, resolve disputes and enforce our agreements.

5.2 Personal identification information is retained for 7 years after the last transaction or as required by applicable law. Financial and tax records are retained for 8 years as per Income Tax Act requirements. Business and compliance records are retained for the period specified by applicable law.

5.3 Communication records and correspondence are retained for 3 years from the date of communication. Technical and usage data is retained for 2 years. Marketing and promotional data is retained until you opt out or withdraw your consent.

5.4 After the retention period expires, we securely delete or anonymise your information in accordance with our data destruction policy and applicable laws.

5.5 However, we may retain your information for a longer period if required by applicable law or for compliance with statutory obligations.

6. YOUR PRIVACY RIGHTS

6.1 You have the right to access your personal information. You may request a copy of the information we hold about you by contacting us using the details provided herein.

6.2 You have the right to correct or update your personal information if it is inaccurate or incomplete. You may make such requests by logging into your account or by contacting us.

6.3 You have the right to erase or delete your personal information, subject to certain legal retention obligations. However, we may retain certain information if required by applicable law.

6.4 You have the right to data portability. You may request your personal information in a structured, commonly used and machine-readable format and have it transferred to another controller.

6.5 You have the right to withdraw your consent for processing of your personal information at any time. However, such withdrawal will not affect the lawfulness of processing before the withdrawal.

6.6 You have the right to opt-out from receiving marketing communications and promotional offers by clicking the "unsubscribe" link in our emails or by contacting us.

6.7 You have the right to lodge a complaint with relevant data protection authorities or regulatory bodies regarding the processing of your personal information or our privacy practices.

7. COOKIES AND TRACKING TECHNOLOGIES

7.1 We use cookies, pixels tags, beacons and similar tracking technologies to collect information about your browsing activities and usage patterns on our Platform.

7.2 We use cookies for the following purposes: to enable the functioning of the Platform, to remember your preferences and login information, to track your usage and interactions, to analyse and improve your experience, to display personalised content and advertisements, and to protect the security of the Platform.

7.3 We use both session-based and persistent cookies. Session-based cookies are deleted when you close your browser. Persistent cookies remain on your device until they expire or you delete them.

7.4 You can manage cookie preferences through your browser settings. Most browsers allow you to refuse cookies or alert you when cookies are being sent. However, blocking cookies may impair your ability to access or use certain features of the Platform.

7.5 Third-party service providers used by us may also use cookies and similar technologies to collect information about your online activities. We do not have control over third-party cookies.

8. CHILDREN'S PRIVACY

8.1 Our Platform and Services are not intended for individuals under the age of 18. We do not knowingly collect personal information from children under 18 years of age.

8.2 If you are a parent or guardian and believe that your child has provided us with personal information, please contact us immediately at the details provided herein.

8.3 If we become aware that we have collected personal information from a child without parental consent, we will take steps to delete such information and terminate the child's account.

9. THIRD-PARTY LINKS AND SERVICES

9.1 Our Platform may contain links to third-party websites, applications and services that are not operated by us. We are not responsible for the privacy practices, content or security of third-party websites or services.

10. INTERNATIONAL DATA TRANSFERS

10.1 Your information is primarily stored and processed in India. However, your information may be transferred to, stored in and processed in countries other than India, including countries which may not have equivalent data protection laws.

10.2 By using the Platform and providing your information, you consent to the transfer of your information to countries outside India for processing.

10.3 We ensure that appropriate safeguards are in place when transferring your information internationally, including standard contractual clauses approved by relevant authorities and adequate data protection commitments.

12.2 You may lodge complaints with the relevant data protection authorities, Ministry of Electronics and Information Technology (MeitY), Consumer Protection Authorities or Cyber Crime Cells.

12.3 We are committed to resolving your concerns promptly. Our Grievance Redressal Officer will acknowledge your complaint within 24 hours and endeavour to resolve it within 15 working days.
